River City Scuba Text Messaging Terms and Conditions
By opting in to receive text messages from River City Scuba (hereinafter, “We,” “Us,” or “Our”) (the “Service”), you agree to these Text Messaging Terms and Conditions (the “Agreement”). This Agreement does not modify or replace any other Terms and Conditions or Privacy Policy that may govern your relationship with River City Scuba in other contexts.
IMPORTANT NOTICE:
Our Terms and Conditions of Use may require disputes to be resolved on an individual basis and not as part of any class or representative action, may waive your right to a trial by jury, and may require claims to be resolved through final and binding arbitration. If you do not agree to these terms, you should not participate in the Service.
1. Providing Telephone Numbers and Duty to Notify
You confirm that the mobile phone number you provide to River City Scuba is accurate and that you are the current subscriber or authorized user of that number. If your contact information changes, including ownership of your phone number, you agree to notify us prior to the change by contacting us at info@rivercity-scuba.com or by calling (706) 748-8995.
2. Consent to Receive Text Messages
By voluntarily providing your mobile phone number, you expressly consent to receive recurring automated and non-automated text messages (including SMS or similar technologies) from River City Scuba related to our products, services, scuba classes, equipment servicing, special orders, scheduling updates, and occasional informational or promotional announcements.
Consent to receive text messages is not a condition of purchase. Message and data rates may apply. Message frequency may vary.
3. Opt-Out and Help Instructions
Your participation in the Service is voluntary. You may opt out at any time by replying STOP to any text message from River City Scuba. You may request help by replying HELP or by contacting us at info@rivercity-scuba.com or (706) 748-8995.
After opting out, you may receive a final message confirming your opt-out. You may re-subscribe at any time by replying START.
4. Indemnification
You agree to indemnify, defend, and hold harmless River City Scuba from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your voluntary provision of a mobile phone number that you do not own or control, or from your failure to notify us of changes to your contact information, including claims under the Telephone Consumer Protection Act (TCPA) or similar state laws.
5. Limitation of Liability
Broadvoice, our messaging service provider, shall not be held liable under any circumstances for disputes, breaches, or disagreements between River City Scuba and any customer or third party. All parties acknowledge that Broadvoice bears no responsibility for resolving, indemnifying, or assuming liability related to any claims or disputes arising from the Service.
6. Participation Requirements
By participating in the Service, you confirm that you are at least eighteen (18) years of age and have access to a mobile device capable of two-way text messaging. Participation requires a supported wireless carrier and an active text messaging plan. Not all mobile carriers support this Service.
7. Miscellaneous
You represent that you have the authority to agree to these Terms and that doing so does not violate any other agreement. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect. We reserve the right to update or modify this Agreement at any time. Continued participation in the Service after changes are posted constitutes acceptance of the revised terms.
